1.   WARRANTIES AND COMPLAINTS

The Customer always has legal warranty rights for a period of two years from the delivery of the product, under the terms and conditions of the law. If you purchased products that were not manufactured by Biosurfit, you may be entitled to (additional) warranty conditions from the original manufacturer. The Customer cannot claim any additional warranty beyond that to which it is entitled under legal guarantees or Biosurfit, or the manufacturer's warranty.
Under Biosurfit's additional warranty on their own brand products, they may be specific regarding raw material or manufacturing defects. A valid complaint gives rise to a free replacement or replacement of the Products, according to Biosurfit´s policy. If replacement or substitution is not possible or reasonable, taking into account the costs incurred, Biosurfit has the obligation, as a final solution, to reimburse the costs. In cases where the customer requests for payment of damages or costs, the Liability and indemnity article applies.
After reporting the defect, the Customer must allow Biosurfit to analyze the Products. The inspection of the defective Product may occur at the place where the Product is located at that time, or at Biosurfit facilities, in accordance with the criteria of Biosurfit. Shipping / restitution costs are covered by Biosurfit, unless the claim under the warranty is denied, in which case the Customer must pay the shipping costs.
Any defects in the Products resulting from normal wear and tear or any other external cause, such as, but not limited to, damage by transportation carried out by the Customer, incorrect use, or if the Customer has made any repairs to the product without the prior written authorization of Biosurfit, will not be covered by the warranty unless such use or repairs are inherent in the use of the Products.
We recommend that you record the serial number of the Product and keep it with the purchase invoice / receipt, as it can be requested in case of future warranty claims.

2.   LIABILITIES AND COMPENSATION

Biosurfit's liability is limited to the extent permitted by law. Biosurfit will never be liable for any damage to the Client if:

  1. The damage results from non-compliance with the manufacturer's liability, unless Biosurfit is legally responsible, under the terms of the law;
  2. The damages are indirect and / or consequential damages.

Notwithstanding the foregoing, or any other provision of these Terms, nothing in these Terms excludes or limits, in any way, Biosurfit's liability for death or personal injury caused by our negligence, fraud or misrepresentation, for any matter relating to which it would be illegal for Biosurfit to exclude, or attempt to exclude, its liability.
In the event of damage, the Customer is obliged to limit, as far as reasonably possible, any additional or other damages.

 3.   RETURNS/ REFUNDS/ RESOLUTIONS

The Customer has the right to terminate the contract (applies to the act of purchase or order) within a period of counting from the delivery in accordance with the terms mentioned below:

3.1 Right to exercise returns

For online purchases, if the customer wants to cancel the purchase (terminate the contract) after the product is delivered, the customer has 14 consecutive days to communicate his withdrawal, without costs or the need to indicate the reason. The term starts from the date of receipt of the product or, in the case of the provision of services, from the date of the conclusion of the contract.

indicating the decision to terminate this contract with an unambiguous statement (for example, letter sent by post, fax or e-mail), to be sent before the end of the return period. The name, NIF and invoice must always be included with the resolution request.

3.2 Refunds

If you terminate this contract, we will reimburse all payments received from you, including delivery costs (with the exception of the extra costs resulting from your choice of a shipping type other than the standard shipping method provided by us), without undue delay and, whatever the case may be, within 14 days from the day we are informed of your decision to terminate this contract. We will proceed with the refund using the same method used for payment, whenever possible, or alternatively bank transfer. In this case, proof of IBAN will be required for this purpose. The return can take 5 to 10 days until it appears on your statement. In any case, the Customer does not incur any costs as a result of this refund. We can withhold the refund until we have received the returned items or until you have provided proof of shipment of the items, whichever is sooner.

3.3 Return of Products

If you choose to exercise your right to return product, you must make the items available for pick-up (free of charge) at an indicated address, without undue delay and, whatever the case may be, within 14 days from the date of communication of the termination. Upon consultation and with prior acceptance, Biosurfit can proceed with the collection of products.

3.4 Liability and Warranty

The Customer is only responsible for the depreciation of the products resulting from handling other than necessary to verify the nature, characteristics and functioning of the product.

All Products purchased from Biosurfit, through the Website https://biosurfit.myshopify.com/, are covered by the guarantee that they meet all quality standards and are suitable for the purposes for which products of the same nature are commonly supplied.

3.5 Precedence of Terms

The terms set out above on the right of return, only apply to contracts with consumers (“any natural person who acts with objectives external to their commercial activity, trade or profession”) and take precedence over the Terms and Conditions of Sale that are and continue to apply to all other contracts and / or issues not covered by these terms.

Biosurfit has the right to return and to ship the purchase of several products, separately.

4. PRIVACY POLICY

The Privacy Policy describes how biosurfit.myshopify.com (the "Site" or "we") collects, uses, and discloses your Personal Information when you visit or make a purchase on the website.

4.3 Promotional messages

When registering on our Site, you can choose to receive promotional communications. Thereafter, you can at any time choose to stop receiving these communications by clicking on the “unsubscribe” link at the bottom of any marketing email or by updating your Messaging Preferences when logging into your account. It may take up to 7 days for the change to take effect. From then on, you will only receive promotional emails again if you change your Messaging Preferences again.

Automated decision making

Biosurfit does not participate in fully automated decision making that has a legal or significant effect using customer data.

Our Shopify processor uses limited automated decision making to prevent fraud that does not have a legal or significant effect on the consumer.

Services that include elements of automated decision-making include:

  • Temporary deny list of IP addresses associated with failed repeated transactions. This deny list persists for a small number of hours.
  • Temporary credit card deny list associated with deny listed IP addresses. This deny list persists for a small number of days.

These general terms and conditions, including all other terms and documents referred to in these (hereinafter referred to as “Terms”) apply to all agreements and any other (legal) relationship between Biosurfit and consumers (hereinafter referred to as "Customer", "you" or "your") formalized through the website: onlinestore@biosufit.com (hereinafter referred to as "Site").

  2. Before ordering any product on our Site, read these terms carefully and print or save a copy for future reference. By using any part of the website, the consumer agrees and accepts these General Terms and Conditions. If the ordered products are no longer available, Biosurfit will inform you of this fact and reject the order.

All statements on the Site regarding values, measurements, descriptions and / or other designations are made with care but serve the purpose of identifying products only and are estimates, unless expressly stated otherwise. Obvious errors, such as pricing errors, calculation errors or typographical errors in offers, promotions, folders, brochures, catalogs, order confirmations, invoices and other written declarations by Biosurfit are not binding.

Biosurfit provides you with adequate, effective and accessible technical means to identify and correct filling errors. Before completing the order, you can change your contact details, delivery address, payment details and / or remove or change the products in your shopping cart, by clicking on the “edit” or “remove” options. When you are satisfied with the information on the checkout page, click on “Confirm order” to proceed with the purchase of the selected products.

The values ​​/ prices shown are in euros and include VAT. The prices indicated are exclusive for purchase through this Site (https://biosurfit.myshopify.com/). The availability of the products presented on the Site is limited to the stock available at any given time. Prices and other descriptions are subject to change without notice, including stock replenishment.

7.   SHIPPING POLICY

7.1 Shipping Costs

In addition to the purchasing costs for the ordered products, the products are shipped from our distribution center, there is no possibility to refuse the related shipping and delivery costs.

The shipping and delivery costs are clearly indicated on the Site during the payment process. For deliveries outside Portugal, delivery costs will be calculated and communicated at the time of order confirmation.

7.2 Delivery and Pick-up

We will make every effort to inform you of the estimated delivery dates when placing an order. The Customer accepts that the maximum delivery period may be 7 days, never exceeding those 7 days. The products will only be delivered after approval of the (contact) data of the Client. If, for example, the data does not comply with these Terms, then Biosurfit has the right to terminate the contract, in which case it will be informed by email or letter.

  • If any item is damaged or missing from your order, please contact us at 218860169 within two months of delivery or, if the order has been delivered to a collection point to be picked-up by the customer within two months from the date the items were collected at the store. Damaged products must be made available or left at a collection point to be picked-up by Biosurfit, without undue delay and, whatever the case may be, within 14 days from the day the Customer contacts us, unless otherwise agreed to by the Customer and Biosurfit.

  • Products are delivered to the location specified at the time the order is placed and the products ordered. Ownership of the goods passes to the Client with full payment of the price and any other amount. The risk of loss or damage to the goods is transferred to the Customer at the time of delivery.

  • The Products will be delivered (by a carrier) to the address indicated by the Customer. Delivery times are indicated on the Site and during the ordering process. If you choose to place your order in more than one order process, different delivery times may apply.

7.3 Shipping to mainland Portugal

Shipping is available to the following districts: Viana do Castelo, Braga, Vila Real, Bragança, Porto, Aveiro, Viseu, Guarda, Coimbra, Castelo Branco, Leiria, Lisboa, Santarém, Portalegre, Setúbal, Évora, Beja, Faro.                                    Deliveries are made between 9:00 am and 6:00 pm and it is not possible to indicate the exact time of the delivery, including orders delivered to Biosurfit collection points for collection by the customer. After shipping, you will receive an email with more information about the shipping and delivery conditions. With regard to delivery to a pick-up location, the order is only available for collection after receiving an email with confirmation that the order is available to be collected. This e-mail must be printed and presented at the time of the pick-up. The driver who performs the delivery needs a confirmation for all Products and if available to accept the delivery.  Please note that the products must not be left at entrances, porches or other places outside the home. Please, when placing your order, indicate the floor for delivery. Please note that we cannot deliver to PO Boxes. The invoice is sent with the order and the driver will ask for an identification document at the time of delivery.

7.4 Shipping to Azores and Madeira islands

Typically, shipments are made by the operators with whom Biosurfit works. Shipping costs are calculated according to the weight of the items (see table here). At the time of order confirmation, you will be informed of the amount. Delivery costs are not included in the total amount shown on the Site until the moment of order confirmation.

     7.5 Shipping Damages

If the Products are delivered with visible (transport) damage, we ask that you please inform the carrier immediately and contact our customer service department as soon as possible. Failure to do so will not affect your rights (to any warranty claims) but doing so will help us file the claim with the carrier or your insurance company.

8.   PRICING AND PAYMENT

The applicable prices are the prices of the products displayed on the Site. Prices include tax  (including VAT) and are in € (Euros). The value of VAT is shown in detail at the time of order completion. You can pay by Credit Card.

        8.1 Credit Cards

We accept the following credit cards: Visa and Mastercard. The amount will be debited from your card when Biosurfit accepts your order.

 Your order will be processed as soon as we receive payment.

 Please note that payment for the Products must be made at the time the order is placed.

When paying with a credit card, the entity responsible for providing the service was STRIPE. No information about the credit card is provided to Biosurfit and the conclusion of the transaction is subject to your acceptance of the terms and conditions that constitute an autonomous contractual relationship between you and your bank. Please make sure that you agree to the terms and conditions before choosing to pay with a credit card.

The right to suspend any payment can only be exercised if your (counter-) claim concerns the same contract.

Prices for our products are subject to change without notice.

We reserve the right, at any time, to modify or discontinue the Service (or any part or content thereof) without prior notice.

We will not be responsible to the consumer or third parties for any modification, price change, suspension or discontinuation of the Service.

You also agree that your comments must not include slanderous or otherwise illegal, abusive or obscene material, or any computer viruses or other malware that may in any way affect the operation of the Service or any related website. If, in our opinion, the customer fails or suspects that it has failed to comply with any term or provision of these General Terms and Conditions, we may also terminate this contract at any time without notice and the consumer will remain responsible for all amounts due and including termination date; and / or, therefore, we may deny you access to our Services (or any part of them).

18. GOVERNING LAW AND JURISDICTION

  • These Terms and Conditions will be governed and interpreted in accordance with the laws of Portugal. The applicability of the 1980 Vienna Convention on Contracts for the Sale of Goods (CISG) is explicitly excluded.
  • Any dispute or claim resulting from, or related to, these Contracts or their creation (including non-contractual disputes or claims) is subject to the non-exclusive jurisdiction of the courts of Portugal.

  • As an alternative to recourse to the competent courts, the Customer may choose to submit any substantiated claim or dispute to a Consumer Dispute Resolution Entity that is territorially competent for that purpose. The list of authorized Consumer Dispute Resolution Entities, containing the respective electronic addresses on the Internet, can be found here on the European Online Dispute Resolution Platform, available at https://ec.europa.eu/consumers/odr/main/?event=main.home.howitworks.

19. CHANGES TO GENERAL TERMS AND CONDITIONS

You can consult the most current version of the General Terms and Conditions at any time on the section 5 of this document. 

Biosurfit reserves the right, in our sole discretion, to update, change or replace any part of these General Terms and Conditions by posting updates and changes on our website. It is your responsibility to periodically check our website for changes. Continued use of or access to our website or the Service after the posting of any changes to these General Terms and Conditions constitutes acceptance of those changes.

21. CUSTOMER RIGHTS

Without prejudice to any exceptions or limitations to which Biosurfit is entitled by law, the Customer will always have the legal right to correct the performance of the contract, terminate the contract and pay damages and / or costs. In relation to any claims for payment of damages or costs, the Liability and Indemnity article of these Terms applies.
